The installer claimed that the county required an aerobic septic
system, so it was installed. Now I find out that it was not required
when a house down the street went in without one. How can I prove
that an aerobic system was not required for my land, I am on 1.2 acres
which is completely flat. I do not trust the local health department
they are all a bunch of crocks. I have a very good suspicion if they
come out there they will say I need an aerobic unit, can I get an
independent perk test that proves I do not need an aerobic system,
then use it to challenge the health dept. I am also then going to
take the installer to court and sue him to make him put a regular unit
in and to make him pay for all damages I have had nothing but problems
from this system

You need a lawyer, not an Internet group.
Keep in mind that perk tests give different results on different lots,
and what may be required for you may not be for a neighbor, and it may
all be quite legal.. Again, you need a lawyer. Be prepared to spend
some money.

And a lawyer who knows this sort of case, not just any lawyer out of the
phone book.

Not to mention the possibility that the neighbor should have put in an
aerobic system, too. Just because they didn't do it and haven't so far
been caught doesn't mean their installation meets code.

How does that show that one wasn't required for YOUR lot?
Maybe the neighbor's is a mistake and in violation. Turn them in so
that they have o put one in, too. Will that satisfy you?

Soil conditions change a LOT in just a short distance. There are 5
houses in my subdivision. 3 of them required mound systems because of
different soil conditions (one has all rock, another all sand, I forget
the third). The one neighbor and I got lucky and we have an area
between our houses that is just perfect for a "normal" septic system.
